Prominent lawyer: VP does not have to be guilty to be impeached
Atty. Trixie Cruz-Angeles in her Facebook page explained how a Vice President can be impeached in the Philippines.
She said it is done the way one impeaches a president.
A complaint must be filed in the House of Representatives by a Congressman or he/she could endorse it.
The complaint then goes to plenary where it must be done within ten days. It will then be referred to a Committee within three days, and the Committee will make a report and recommendation to plenary within sixty days.
Afterwards, one-third of votes from all Members of the House must be given to either affirm or override the recommendation, then if the vote is to file, the verified complaint or the resolution of impeachment become the Articles of Impeachment which are then forwarded to the Senate.
When all that is done, the Senate conducts the trial where the Chief Justice of the Supreme Court will preside.
"Strictly speaking, "impeachment" refers to the proceedings in the House. Thus, one can be "impeached" even if not found "guilty" by the Senate," the lawyer said.
She said the Senate does not find "guilt" because it cannot conduct a criminal proceeding.
"Grounds for impeachment are: culpable violation of the Constitution, treason, bribery, graft and corruption, other high crimes, or betrayal of public trust."
