Malacañang officials issued a statement saying that although public safety is put in “imminent danger” with regards to the worsening drug menace, the President is unlikely to declare martial low nor to allow a constitutional crisis to happen.
Chief presidential legal counsel Salvador Panelo said that despite the public currently being in imminent danger and the fact that the Constitution can easily back up the President if he wishes to do so, Duterte won’t declare martial law—a topic that is again being rightly brought back into the spotlight in connection with the burial of former President Ferdinand Marcos at the Hero’s Cemetery.
Chief Justice Maria Lourdes Sereno may have just misunderstood the message behind Duterte’s public announcement of his list that included judges, mayors, and police officers who are allegedly involved in illegal drug trade.
Communications Secretary Martin Andanar also denied that the President is setting the stage for martial law. “The President merely asked a rhetorical question and said it under the context that his anti-drug campaign cannot wait for the slow wheels of justice—Philippine Style,” Andanar explained.
President Duterte’s dismay over Sereno’s stand was reiterated during his speech before a crowd of soldiers in Labangan, Zamboanga del Sur yesterday.
Meanwhile, Panelo believes that Duterte’s shame campaign is necessary to end the drug operations of drug syndicates. He also expressed his disbelief on the claims that the administration is tolerant on the killing of suspected drug dealers.
“First, no one is justifying the killings. First, the killings are being done by the drug pushers themselves. And therefore, these surrenderees would necessarily point to the authorities who the drug lords and the drug pushers are. It ends up with their killing each other.”
Furthermore, Panelo said that the President will only declare martial law “when he is forced to”, since Duterte would never allow a constitutional crisis to happen during his term. ASCS
